A lot has been said, discussed and debated about the Information Technology Act, 2000 and how it is expected to give a quantum jump to e-commerce in India. Unfortunately, the Act deals only with the narrow issue of recognising digital signatures and setting up certification authorities which will co-ordinate and regulate the process. It does not (and to be fair) was not expected to be a panacea for all sorts of ills and new liability issues which inevitably arise from the use of the net. In the recent years, governments across the world have made attempts to regulate the Internet. The common belief that it is unregulated is a fallacy and is best dispensed as soon as possible.

Rodney D. Ryder is the founding partner at Scriboard and is a leading technology, intellectual property and corporate lawyer. He is the author of Guide to Cyber Laws: the Information Technology Act, 2000, E-Commerce, Data Protection and the Internet, the first section-wise analysis of the Indian Information Technology Act, 2000.
